Northfield Insurance Company (“Northfield”) issued a commercial general
liability policy to Metro International Church Inc. (“Metro”) for the premises Metro leases from
Bushwick at 871 Bushwick Avenue in Brooklyn (“Premises”).
Multiple people have started lawsuits against Bushwick and/or Metro alleging
personal injuries sustained at the Premises. This case concerns two.
In Merquicedes Abreu Jimenez v. Bushwick Realty Holding LLC, Index No.
502616/2023 (“Jimenez Case”), the plaintiff alleged that she suffered a personal injury at the
Premises. Bushwick tendered the claim to Metro under the indemnity provision of its lease. And
in a March 9, 2023 letter from Mikabreanna Napier, Northfield “accept[ed] the tender for
contractual defense and indemnification” and retained defense counsel for Bushwick.
But for some inexplicable reason, Northfield disclaimed in Dionicia Cruz v.
Bushwick Realty Holdings LLC, Index No. 533796/2023 (“Cruz Case”), even though the facts are
