Overview
This is an action for declaratory judgment arising out of a contract for mold
remediation services at GAF’s plant located at 2520 Oscar Johnson Drive, Charleston, South
Carolina.
GAF and Low Country Restoration Services, LLC entered into a Master Services
Agreement specifying that each party “consents to the exclusive jurisdiction of any state or federal
court located in the Borough of Manhattan, City of New York, for any actions, suits or proceedings
arising out of relating to this Agreement or any Statement of Work.”
Notwithstanding this contractual forum selection clause, Restoration filed a
mechanic’s lien against the above-referenced property in the Office of the Register of Deeds, State
of South Carolina, County of Charleston, demanding the sum allegedly due of $334,036.74 from
GAF Materials, LLC.
