The Petitioner, LGC Partnem, LLC, by its attomeys of record, Patricia L Lynch, on notice to
the following intemsted parties and Respondents herein, A.B., Allstate Assignment Company, and
Allstate Lifb Insurance Company, respectfully alleges, as follows:
1. This is a special paceeding pasuant to New York's The Structmed Settlement
Pmtection Act, Gen. Oblig. Law §5-1701 et seq. (the "SSPA"), seeking approval of the sale and
transfer of certain structured settlement payment rights due under a structured settlement agreement, in
accordance with 26 U.S.C. §5891 et seq. and Gen. Oblig. Law §5-1701 et seq.
"Transferee"
2. The Petitioner, LGC Patners, LLC, is deemed a as said term is defined in
Gen. Oblig. Law §5-1701(t).
3. 1he Respondent, A.E., is a competent adult individual who is domiciled and resides in
"Payee"
the County of Nassau, and is deemed a as said term is defined in Gen. Oblig. Law §5-1701(h)

(hereinafter, and/or"Payee").
4. Jurisdiction exists in the Supreme Court, of Nassau because Nassau County is

6. The "interested noticed of the special proceeding herein are:
a. The Transferor, who consent to and joins in this application, as evidenced by the
transfer agreement and other papers (i.e., the "Purchase, Sale, and Transfer
Agreement") consummated by and between the 'Itansferor and LGC Partners,
LLC;
b. Alislate Assignment Company ("ALLSTATE"), which, upon information and
is an insurance anthorimi to do business in the State of New

and is deemed an "Annuity Issuer", as said term is dermed in Gen. Oblig, Law
§5-1701(a), in connection with the structured settlement payment rights at issue
in this proceeding.
7. Upon information and belief, the Payee is married, has no minor children, ad has no
other dependents or beneficiaries under the structmed setdement payment rights which are the subject

of this paceeding. Annexed hereto as Exhibit are true and correct copies of the Payee's Statement
of Dependents and Certificate of Marital Status.
8. Upon information and belief, as a result of a settlement of a claim involving allegations
of exposure to lead-based paint, the Transfemr hecame a beneficiary of certain structured settlement
settlement"
payments, which provided for a series of deferred cash payments under a "structured as

dermed in Gen. Oblig. Law §$-1701(1) and 26 UAC. §5891(c)(1). Annexed hereto as Exhibit is a
true and correct copy of the Payee's AiBdavit in Lieu of Settlement Agreement.
9. Upon information and belief, the structmed settlement was the subject of a "qualified
assignment", pursuant to Internal Revenue Code §§104 and 130, 26 U.S.C. §§104 and 130, as a result
of which ALLSTATE assumed the liabilities of the structured settlement obligor to make the payments
provided ibr under the structured settlement,
10. Upon information and belief, the Structured Settlement Obliger funded its obligation to
make the structured settlement
