DEFENDANTS’ MOTION TO COMPEL PLAINTIFF’S DEPOSITION FOR RELIEF
FROM JANUARY 9, 2017 ORDER AND FOR SANCTIONS
Defendants, MEDNAX, INC., PEDIATRIX MEDICAL GROUP OF
FLORIDA, INC. and ANGELINA PERA, M.D., pursuant to Fla. R. Civ.
P. 1.310, file this Motion to Compel Plaintiff’s Deposition, for
Relief from January 9, 2017 Order and for Sanctions and state as
follows:
1. On December 9, 2016, co-Defendants TANYA MEDINA, M.D.;
J. RAPHA MEDICAL, P.A. d/b/a OSCEOLA WOMEN AND FAMILY MEDICINE
SPECIALISTS (hereafter collectively “Dr. Medina”), filed a
Notice of Taking Deposition Duces Tecum of Plaintiff, Ninoshka
Rivera. The deposition was set for February 17, 2017. Exhibit A.
2 on January 12, 2017, Defendants MEDNAX, INC.,
PEDIATRIX MEDICAL GROUP OF FLORIDA, INC. and ANGELINA PERA, M.D.
(hereafter collectively “Dr. Pera”), filed a Cross-Notice of
Taking Videotaped Deposition of Plaintiff. Exhibit B.
3 On January 5, 2017, Plaintiff filed a Motion to Compel
Deposition of Defendants’ Witnesses requesting deposition dates
for Dr. Pera and Dr. Medina. Exhibit C.
4 On January 9, 2017, the parties attended a hearing on
Plaintiff's Motion. Counsel for Dr. Pera agreed to provide a
deposition date for Dr. Pera to occur within 45 days from the
Plaintiff’s deposition. At that time, Plaintiff's deposition was
set for February 17, 2017 so Dr. Pera had to provide dates on or
before April 3, 2017. This agreement was memorialized in this
Court’s January 9, 2017 Order. Exhibit D.
5 On February 1, 2017, Dr. Medina provided dates of
availability for her deposition. Exhibit kE.
6. On February 10, 2017, Dr. Pera provided five dates of
availability for her deposition. All of the dates provided were
prior to April 3, 2017. Exhibit F.
7. The same day, counsel for Dr. Pera was copied on a
letter from Plaintiff’s counsel to counsel for Dr. Medina.
Plaintiff’s counsel indicated that the deposition of Mrs. Rivera
was not going forward on February 17, 2017 due to Dr. Medina’s
alleged failure to comply with this Court’s January 9, 2017
Order. Exhibit G.
8. Later that day, Plaintiff's counsel emailed counsel
for Dr. Pera and Dr. Medina confirming that the parties counsel
had discussed dates for Dr. Medina’s deposition. Exhibit H.
9. Counsel for Dr. Medina then emailed all parties in the
case, indicating that she would like to move forward with
Plaintiff’s deposition on February 17, 2017. Exhibit I.
10. On February 15, 2017, Plaintiff's counsel filed a
Notice of Cancellation of the Deposition of Mrs. Rivera.
Exhibit J.
il. The exhibits attached to this motion show that Dr.
Pera and Dr. Medina provided deposition dates in compliance with
the Court Order.
12. Plaintiff's unilateral cancellation of Mrs. Rivera’s
deposition was in bad faith and unjustified. Further, the
cancellation had no factual basis and was actually in violation

of the Court’s January 9, 2017 Order which was executed by the
parties and this Court based Plaintiff
on counsel’s
representation that her client’s deposition would occur on
February 17, 2017.
13. Plaintiff’s cancellation constituted contempt of Court
because it contravened the valid and duty entered Order of this
Court and hindered the orderly progression of this matter.
14. Therefore, Defendant respectfully requests that this
Court issue an Order providing the following:
a) Compel Plaintiff’s counsel to provide dates for Mrs.
Rivera’s deposition to occur on or before April 3,
2017;
b) Relieve Defendant from the January 9, 2017 Order which
requires Defendant to provide deposition dates for Dr.
Pera within 45 days of Plaintiff's deposition; and
c) Find Plaintiff’s counsel in contempt of Court and
assess a compensatory civil contempt sanction to
compensate Defendant for damages incurred as a result
of this act and a civil contempt sanction to deter
Plaintiff’s counsel from taking a similar action in
the future.

Plaintiffs are in, need of the above styled depositions to further prepar
e their cases for
trial onthe contested issues of liability and damages.

3 Importantly, Plaintiffs, through no fault of their own, have been unable to secure the
aforementioned depositions due to the Defendants’ delay tactics of not providing undersigned
counsel with available dates. Such conduct is strategically aimed at hindering Plaintiffs from
moving this matter forward.

2 To illustrate, undersigned counsel previously requested available deposition dates
of the aforementioned deponents but to no avail. A copy of Plaintiffs’ Notice of Filing written
correspondence seeking dates from the aforementioned deponents is attached hereto as Exhibit
A. Pursuant to the written correspondence attached hereto, counsel for Plaintiffs have made good
faith written attermpts to obtain deposition dates of Defendants, TANYA MEDINA, M.D., and
ANGELINA PERA, M.D. since June of 2014.
3 To the extent that the Defendants did not make themselves available for
depositions despite Plaintiffs’ good faith requests for the same, Plaintiffs have been forced to
move this Court for an Order compelling depositions on two separate occasions. A copy of
Plaintiffs Motions to Compel Deposition are attached hereto as Exhibit B. Notwithstanding this
unnecessary motion practice, Plaintiffs have still not been able to secure the requested
depositions as of this date.
4 This case has been ongoing for five years. At this point, it is imperative that
Plaintiffs’ obtain deposition dates for the above-listed Individuals, The depositions requested by
Plaintiffs’ are reasonably calculated to lead to the discovery of admissible evidence. The
inability to conduct depositions of these pertinent witnesses will significantly prejudice
Plaintiffs’ prosecution of this case.
5 : Therefore, Plaintiffs ‘respectfully request this Court issues an order determining a
deadline for the above-listed individuals to provide availability for depositions to Plaintiff within
ten (10) days and produce the above-listed individuals for deposition within forty-five (45) days.
WHEREFORE, Plaintiffs’ respectfully requests the Court to enter an Order compelling
the above-mentioned individuals for deposition within forty-five (45) days of entry of an Order.
