                        MOTION TO OPEN DECEDENT’S SAFE DEPOSIT
                               BOX-CONTENTS UNKNOWN

          COMES NOW, Esther Valee Taylor, by and through her attorney of record, Wallace W.

Trosen, LLC, and for her Motion To Open Decedent’s Safety Deposit Box-Contents Unknown,

states:

     1._. That she has knowledge and acknowledgment that the safe deposit box numbered B47 is

          located at LaPlata State Bank, and was the Decedent’s, Jimmie D. Taylor, Jr.

          That Jimmie D. Taylor, Jr. is Movant’s late husband, who passed on November 18, 2023.

          That this Movant has in her possession the key for said safe deposit box.

          That the contents of the safe deposit box are unknown to Movant.

          That under Section 362.488 RSMo, the safe deposit box may be opened after the death of

          the lessee of the box, in the presence of persons claiming to be interested in the contents

          thereof, by two employees of the lessor, one of whom shall be an officer of the lessor;

          and such employees may remove all instruments of a testamentary nature and deposit the

          same with the Probate Division of the Circuit Court.

          That under Section 362.488 RSMo, the remaining contents of all other safe deposit boxes

          so opened shall be kept and retained by the bank, trust company, or safe deposit company

          and shall be delivered only to the parties legally entitled to the same.

     7.   That the Movant, Esther Valee Taylor, as the surviving spouse of Decedent, Jimmie D.
Taylor, Jr., is an interested person as to the contents of the safe deposit box for the

         purposes of Section 362.488.

    8.   That Movant, Esther Valec Taylor, requires a list of the unknown items in the safe

         deposit box so as to further settle Decedent’s estate matters.

   WHEREFORE, Movant prays for an order ordering the LaPlata State Bank to deliver a list of

the unknown contents of safe deposit box B47 to Movant; that any testamentary instruments of

safe deposit box B47 be delivered to the Probate Division of the Macon County Circuit Court;

and, for such other orders that are just and proper.

    The undersigned swears that the matters set forth in the above are true and correct to the best

knowledge and belief of the undersigned, subject to the penalties of making a false affidavit or

declaration.
