I am an Assistant Vice President of NBT Bank, National Association (the "Plaintiff"), a national banking association organized and existing under the laws of the United States of America having an office for the transaction of business at 52 South Broad Street, Norwich, New York 13815. 2. I make this Affidavit in support of Plaintiff's application for an ORDER OF SEIZURE. 3. This Affidavit is based upon my personal knowledge and a review of the Plaintiff's books and records. 4. Defendant Tracey L. Breese is an individual who resides at, upon information and belief, 25 Columbus Street, Apt. #1A, Auburn, New York 13021. 5. On or about November 22, 2019, the Defendant made and delivered to NBT Bank, National Association, for value received, a PROMISSORY NOTE (the "Note"), in writing, dated on that day, whereby she promised to pay to the order of NBT Bank, National Association, its successors or assigns, the sum of Sixty Nine Thousand Four Hundred Forty Seven and 11/100 Dollars ($69,447.11) with interest, all as set forth in the Note, a copy of which is attached hereto and 1 made a part hereof as Exhibit "1". 6. The Note is secured by, among other things, a security interest and lien with respect to a 2020 Champion Redman Northwood mobile home, Serial Number: 122000HA008233AB (the "Collateral"), which security interest was pledged by Defendant pursuant to a CONSUMER SECURITY AGREEMENT dated November 22, 2019, a copy of which is attached hereto and made a part hereof as Exhibit "2". 7. The Plaintiff perfected its first priority security interest and lien with respect to the Collateral as evidenced by the NYS Department of Motor Vehicles Lien Verification Report, a copy of which is attached hereto and made a part hereof as Exhibit "3". 8. The Defendant failed or refused to pay installments of principal and interest due as required by the repayment terms set forth in the Note. 9. An event of default exists under the Note by reason of the Defendanes failure or refusal to make the payment due on October 2023 and on the 23rd of each month 23, day thereafter. 10. The amount due the Plaintiff on account of the indebtedness evidenced by the Note is, as of March 25, 2024, Sixty Five Thousand Six Hundred Thirty One and 87/100 Dollars ($65,631.87) consisting of principal in the amount of Sixty Two Thousand Seven Hundred Two and 26/100 Dollars ($62,702.26), interest to March 25, 2024 in the amount of Two Thousand Three Hundred Eighty and 37/100 Dollars ($2,380.37), late fees in the amount of Twenty Five and 00/100 Dollars ($25.00), and negative escrow in the amount of Five Hundred Twenty Four and 24/100 Dollars ($524.24). 11. Interest accrues at the per diem rate of Twelve and 87/100 Dollars ($12.87) for each day subsequent to March 25, 2024. 2 12. The Plaintiff has demanded, and hereby demands, that the Defendant surrender possession of the Collateral to or at the direction of the Plaintiff, but the Defendant has failed and refused to deliver the Collateral and still refuses to do so. 13. The Defendant is in possession of, and wrongfully retains from the Plaintiff, the Collateral. 14. The Collateral is located at 2006 Nauvoo Road, Port Byron, New York, which is real property owned by Defendant and her husband. The Collateral is presently occupied by Defendant's daughter and her family. The occupants have refused to vacate the Collateral. Plaintiff is unable to repossess the Collateral by consent or, upon information and belief, without a (possible) breach of the peace. 15. The Plaintiff is entitled to the Collateral pursuant to its rights as a secured creditor. 16. The Plaintiff is presently unable to accurately state the value of the Collateral, and respectfully requests that the Court defer its decision with respect to the amount of the undertaking to be required herein until such time that an inspection of the Collateral can be made and an accurate value of the Collateral determined. 17. The Plaintiff is prepared to deliver an appropriate undertaking to the Court as directed at the time this Court considers Plaintiffs application for an ORDER OF SEIZURE. 18. In order to protect the Plaintiff's rights and the Collateral, this action has been commenced prior to the submission of this Affidavit to the Court. 19.
