I am the Petitioner herein, and I make this Petition in support of the instant Order to Show Cause seeking leave to file a late Notice of Claim with The New York City Housing Authority. I am fully familiar with the instant facts and circumstances. 2. On October 12, 2023, I was caused to fall while walking down the steps in my 144* apartment building located at 133 W. Street, New York, New York. I fell because of the dangerous condition existing on the stairway between the fourth and third floor. On April 9, 2024, I took a photograph of the condition which caused me to fall. That photograph is annexed hereto as exhibit B. The photograph fairly and accurately depicts the condition of the stairs at the time of my fall on October 12, 2023. Indeed, the stairway had been in that condition for many months if not years. NYCHA was responsible for maintaining the subject stairs, yet it was in that condition, nonetheless. 3. NO. 1 RECEIVED NYSCEF: 05/09/2024 an ambulance. An ambulance did arrive and transported me to Harlem Hospital Center. I subsequently was diagnosed with a fracture of the right ankle and underwent surgery to repair the fracture. 4. At this point in time, all I am seeking is an opportunity to establish the merits of this claim. It would be tremendously unfair if I was denied my day in Court 5. No prior request for the same or similar relief has been made to this or any other Court. WHEREFORE, it is respectfully requested that the instant application be, in all respects granted, that the Notice of Claim in the Form annexed hereto be deemed served timely, and for such other and further relief as to this Court deems just and proper in the circumstances.
