appealed from is dated January 10, 2011 and was entered in

6 The nature and object of the cause of action or
special proceeding is as follows: The action is for, among
other things, reimbursement of insurance benefits allegedly
paid by plaintiff to its subrogor, 14 East 75°* Street, InGs
in connection with a fire which took place on October 7,
2006 (“the fire”) which originated in condominium unit 8A
(“the Bolton Apartment” within 14 East 75‘> Street, New
Yorks New York (“the Building”).

This is an appeal from the Decision and Order of
the Supreme Court, New York County (Freiman, I ) that: (V)
denied summary judgment to Stark on all claims and cross-
claims.
8 Stark contends the Trial Court erred in denying
Stark’s Motion for Summary Judgment. There is no evidence
Stark was negligent and the Stark caused the fire at issue.
Furthermore, there is no evidence Stark is liable for the
tort of any other contractors involved in this action.
