“Article V, section 5(b) of the Florida Constitution…allows circuit courts to issue writs in furtherance of the full exercise of their jurisdiction, including the writ of injunction (now usually referred to as a temporary injunction).” (See Byrd v. Black Voters Matter Capacity Bldg. Inst. (2022) 339 So. 3d 1070, 1073.)
“By whatever name, it has but one purpose: to maintain the status quo…The function of the writ is solely preservative or preventative—to preserve the subject matter in controversy until a final disposition after a trial.” (See id.)
“For 140 years or more, the Florida Supreme Court has recognized the limited purpose of a temporary injunction as this: to preserve the property or rights in statu quo, until a satisfactory hearing upon the merits, without expressing and indeed without having the means of forming an opinion as to such rights." (See id; Sullivan v. Moreno (1882) 19 Fla. 200, 215; Planned Parenthood of Greater Orlando, Inc. v. MMB Props. (2017) 211 So. 3d 918, 924 [As this Court acknowledged long ago, the purpose of a temporary injunction is to preserve the status quo while final injunctive relief is sought].)
“The purpose of a temporary or preliminary injunction is not to resolve disputes, but rather to prevent irreparable harm by maintaining status quo until a final hearing can occur when full relief may be given." (See Michele Pommier Models, Inc. v. Diel (2004) 886 So. 2d 993, 995–96; Byrd v. Black Voters Matter Capacity Bldg. Inst. (2022) 339 So. 3d 1070, 1078.)
Section 106.27 of the Florida Statutes governs election injunctions.
“Upon a proper showing that such person, political committee, affiliated party committee, or political party has engaged, or is about to engage, in prohibited acts or practices, a permanent or temporary injunction, restraining order, or other order shall be granted without bond by such court, and the civil fines provided by this chapter may be imposed.” (See Fla. Stat. § 106.27(2).)
“Civil actions may be brought to enjoin temporarily the issuance of certificates of election to successful candidates who are alleged to have violated the provisions of this chapter or chapter 104.” (See Fla. Stat. § 106.27(3).)
“Such injunctions shall issue upon a showing of probable cause that such violation has occurred. Such actions shall be brought in the circuit court for the circuit in which is located the officer before whom the candidate qualified for office.” (See id.)
“To state a cause of action for injunctive relief, the moving party is required to prove the following:

“The movant must also establish a substantial likelihood of success on the merits.” (See id; See In re Guardianship of Schiavo (2001) 792 So.2d 551, 562.)
“In Joughin v. Parks (1932) 107 Fla. 833, 143 So. 145, the Florida Supreme Court held that: An injunction will not issue for the purpose of restraining the holding of an election, or of directing or controlling the mode in which, or of determining the rules of law in pursuance of which, an election shall be held, because the holding and conduct of an election during its progress is a political matter with which courts of equity have nothing to do.” (See Wexler v. Lepore (2004) 878 So. 2d 1276, 1282.)
“Only where, prior to an election, a palpable violation of the registration or election laws is about to take place, is an injunction an appropriate remedy.” (See id.)
“The rule is well-settled that equity will neither determine questions involving rights that are purely political nor will it undertake the protections of such rights by the writ of injunction.” (See id; Joughin v. Parks (1933) 107 Fla. 833, 147 So. 273, 273.)
“This court reviews temporary injunctions for abuse of discretion.” (See Colucci v. Kar Kare Automotive Group, Inc. (2006) 918 So. 2d 431, 435-36; Stephan Co. v. Faulding Healthcare (IP) Holdings, Inc. (2003) 844 So.2d 676, 678; Raulerson v. Mitchell (2005) 916 So.2d 891.)
“The Florida Supreme Court has stated that [t]he scope of review [of injunctions] is limited. As a general rule, trial court orders are clothed with a presumption of correctness and will remain undisturbed unless the petitioning party can show reversible error." (See id; Smith v. Coalition to Reduce Class Size (2002) 827 So.2d 959, 961; Operation Rescue v. Women's Health Ctr. (1993) 626 So.2d 664, 670.)
It is well settled that “[t]he writ of injunction is an extraordinary, not an ordinary, everyday writ, and it should never be granted lightly, but cautiously and sparingly." (See Byrd v. Black Voters Matter Capacity Bldg. Inst. (2022) 339 So. 3d 1070, 1075; Godwin v. Phifer (1903) 51 Fla. 441, 41 So. 597, 602; see also Thompson v. Plan. Comm'n of City of Jacksonville (1985) 464 So. 2d 1231, 1236 [recognizing that the issuance of a preliminary injunction is an extraordinary remedy which should be granted sparingly].)
It is also well settled that “a circuit court cannot grant one if the effect would be to change the status." (See Bowling v. Nat'l Convoy & Trucking Co. (1931) 101 Fla. 634, 135 So. 541, 544; Byrd v. Black Voters Matter Capacity Bldg. Inst. (2022) 339 So. 3d 1070, 1075.)
