“Rule 12(f) of the North Carolina Rules of Civil Procedure, allows the court to strike from any pleading any insufficient defense or any redundant, irrelevant, immaterial, impertinent, or scandalous matter.” (See Reese v. City of Charlotte (2009) 196 N.C. App. 557, 567.)
"The purpose of Rule 12(f) is to avoid expenditure of time and resources before trial by removing spurious issues." (See Womack v. Town of Kitty Hawk (2007) 181 N.C. App. 1, 15.)
“Unless an allegation in a complaint has no possible bearing upon the litigation, matters alleged in the complaint should not be stricken.” (See id.) "If there is any question as to whether an issue may arise, the motion should be denied." (See id.)
“As the motion to dismiss under 12 (b) (6) is the device to test the fundamental sufficiency of a complaint, so the motion to strike under Rule 12 (f) is the device to test the legal sufficiency of an affirmative defense.” (See Trust Co. v. Akelaitis (1975) 25 N.C. App. 522, 525.)
“Ordinarily Rule 12 (f) requires that a Motion to Strike be made before responding to a pleading.” (See Clouse v. Motors, Inc. (1972) 14 N.C. App. 117, 118.)
“Rule 12 (f) requires that a motion to strike be filed within 30 days after service of the pleading if no responsive pleading is permitted.” (See Daily v. Mann Media, Inc. (1989) 95 N.C. App. 746, 748.)
“In considering a motion to strike pleadings under Rule 12 (f), [g]enerally, well-pleaded facts are accepted as true . . . and matters outside the pleadings will not be considered . . ." (See id.)
“Rule 12 (f) motions are viewed with disfavor and are infrequently granted." (See id.)
“However, if it is clear that the pleading has no possible bearing upon the litigation[,] the pleadings should be stricken.” (See id.)
“Rule 12(f) motions are addressed to the sound discretion of the trial court and its ruling will not be disturbed absent an abuse of discretion.” (See Reese v. City of Charlotte (2009) 196 N.C. App. 557, 567.)
“A [trial] court by definition abuses its discretion when it makes an error of law.” (See Cmty. Success Initiative v. Moore, No. 331PA21, at *24 (N.C. Apr. 28, 2023).)
It is well settled that “allegations should be stricken only when they are clearly improper, impertinent, irrelevant, immaterial, or unduly repetitious.” (See Paris v. Aggregates, Inc. (1967) 271 N.C. 471, 479.)
It is also well settled that a “matter should not be stricken unless it has no possible bearing upon the litigation. If there is any question as to whether an issue may arise, the motion [to strike] should be denied.” (See Reese v. City of Charlotte (2009) 196 N.C. App. 557, 567.)
