Plaintiffs' motion for a trial preference pursuant to CCP 36(a) is GRANTED for the reasons set forth below. The instant case is currently set for trial in May. In the event trial does not go forward at that time, this matter shall be set for trial on or before July 17, 2009. (CCP 36(f)).
This is plaintiffs second motion for a trial preference. Earlier a preference was sought based upon the condition of plaintiff Anna Marie Wong. That motion was denied by this court without prejudice to its reassertion based upon additional medical evidence. Now plaintiff Kwock Bin Wong ("Mr.. Wong") seeks a trial preference. The instant case is set for trial in May. Plaintiff still seeks preference, however as his counsel has observed that some cases particularly lengthy cases (this case is estimated to require 20-25 days to try) often do not go out when originally scheduled.
