The Court finds: the Decedent is dead; venue is proper; the time limit for commencement of this proceeding, seeking adjudication of intestacy, has expired, as more than five years have passed since the Decedent's death. However, the requirement as described under HRS 560:3-108(a)(4) authorizing tardy probate or appointment has been met; the Decedent left no valid will, and therefore, died intestate; the Estate of the Decedent be distributed pursuant to HRS 560:2-103(3); the Decedent's domicile at death was as stated in the petition; the Decedent's heirs are as stated in the petition. Petitioner is appointed to serve as Personal Representative without bond. Letters of Administration shall issue for a period of three (3) years, unless renewed for good cause, with the following limitations on power: The personal representative has no right to possess estate assets as provided in HRS section 560:3-709 beyond that necessary to confirm title thereto in the successors to the estate and claims other than expenses of administration may not be presented against the estate.
