ORDER: Approving Class Action Settlement and Dismissing Case with Prejudice Pursuant to Mass. R. Civ. P. 23, this Court held a hearing on December 3, 2019 to consider the Joint Motion for Final Approval of Class Action Settlement ("Motion"). The Court hereby allows the Motion. The Court certifies the following class for settlement purposes ("Settlement Class"): all remote and client support/field engineers who worked in Massachusetts for Coreintelligent at any time between January 12, 2015 and December 31, 2016, excluding remote and client support/field engineers who worked outside of Massachusetts and/or were hired into senior-level positions and/or reported no overtime hours. The Court otherwise finds and order as follows: (a) The Settlement Class, as defined above, satisfies the requirements of class certification for settlement purposes. (b) The notice mailed to the members of the class and the Reminder Notice that shall be mailed to the members of the class who have not filed a claim for as per the Supplemental Submission in Support of Assented-to Motion for Final Approval of Class Action Settlement (Dec. 3, 2019), adequately inform the members of the class of the terms of the settlement, consistent with Mass. R. Civ. P. 23(c) and (d). (c) The terms of the settlement, including the distribution and allocation of settlement funds, are approved as fair, reasonable, and adequate. (d) The Court will retain jurisdiction over this action and the parties to administer, supervise, interpret, and enforce this Order, but this case is otherwise dismissed with prejudice. SO ORDERED this 9th day of December 2019.
