2 Under date of August 29, 2019, Capstone and Green Field entered into a
subcontract (“Subcontract”) in the principal sum of $1,995,000.00 by which Capstone
BER-L-004171-21 06/28/2021 2:23:30 PM Pg 5 of 9 Trans ID: LCV20211541217
agreed to furnish labor, material, equipment and other work on the Project as required by
the plans and specifications incorporated therein (“Work”).
3 Thereafter, Capstone commenced performance of its Work, and duly
performed all terms and conditions on its part to be performed, except insofar as its
performance was waived, hindered, disrupted, or delayed, including, but not limited to,
any breaches of contract by Green Field.
4 Green Field material breached the Subcontract, and acted in a manner not
contemplated by the parties at the time of contracting, by actively interfering, disrupting,
delaying, hindering and causing the suspension of Green Field’s work.
Green Field’s aforesaid conduct forced Capstone to perform its work over a
longer period of time, and to perform it in a manner not contemplated at the time of
contracting, in an out-of-sequence, inefficient and more expensive manner, including, but
not limited to, performance under winter weather conditions.
6 By reason thereof, Capstone has suffered damages.
WHEREFORE, Plaintiff, Capstone Contracting Corp. demands judgment against
Defendant, Green Field Construction Group, LLC for damages, interest, costs of suit,
any counsel fees permitted by law, and such other and further relief as this Court deems
equitable and just.
