THE COURT FINDS as follows: Pursuant to the Order dated December 11, 2017 by the Presiding Judge, the case of Fambrough v. City of Redwood City, 17C1V05387, was single assigned for all purposes to the Honorable Marie S. Weiner in Department 2 of this Court. The Frambrough case is brought by disgruntled tenants of the Docktown Marina regarding their displacement under the Docktown Plan. After denial of class certification, in January 2020, the Court granted intervention by multiple individual Plaintiffs, specifically, ALLISON MADDEN; WILLIAM MICHAEL FLEMING; EDWARD STANCIL; JEDRICK HUMPHRIES; ALBA LUCIA DIAZ; JONATHAN REID; TINA REID; and JOHN CHAMBERS, as well as others who have since dismissed their claims. Multiple unlawful detainer actions were filed by the City of Redwood City against residents of Docktown, and some of those action have already been deemed “related cases” and reassigned to Department 2 — including 18UDL00810, 18UDL00816, 18UDL00817, 18UDL00822, 18UDL00903, and 18UDL823. Plaintiff City of Redwood City file a Notice of Related Case in 18UDL00809, 18UDL00811, 18UDL00812, 18UDL00818, and 18UDL00820 on November 2, 20218. Defendants in 18UDL00812, 18UDL00818, and 18UDL00820 are also Plaintiffs in Intervention in 17CIV05387. The Notice of Related Case indicates that the other UDL cases assigned to Department 2 are also “related cases” to these Unlawful Detainer actions, and that 17CIV05387 is also a “related case.” No one filed any Response to the Notices of Related Case, pursuant to CRC Rule 3.300(g), contesting that the cases are related. The fact that they are “related” is conceded. A review of the cases also reflects that the Notices of Related Case are accurate in stating that the case “involves the same parties and is based on the same or similar cases” and “arises from the same or substantially identical transactions, incidents, or events requiring the determination of the same or substantially identical questions of law.” A review of the cases reflects that they involve mostly identical parties, they involve claims against possession of the same property, they arise from the same or substantial identical transactions, incidents, and events requiring the determination of common questions or law or fact, and/or are likely to require substantial duplication of judicial resources if heard by different judges. The Court finds under CRC Rule 3.300 that these cases are “related”. The Court finds that 17CIV05387 is the earliest filed case and that it was previously single assigned for all purposes to Department 2, Hon. Marie Weiner. Pursuant to CRC Rule. 3.300(h)(1), this Court is empowered and authorized to “determine whether the cases must be ordered related and assigned to his or her department”. Accordingly, IT IS HEREBY ORDERED as follows: The civil actions of Redwood City v. Behrend 18UDL00809, Redwood City v. Diaz 18UDL00811, Redwood City v. Fleming 18UDL00812, Redwood City v. Reid 18UDL00818, and Redwood City v. Samuelson/Humphries 18UDL00820 are deemed related to Fambrough v. City of Redwood City, 17CIV05387, and related to each other. 2. As the earliest filed action was assigned for all purposes to Department 2, the related cases of Redwood City v. Behrend 18UDL00809, Redwood City v. Diaz 18UDL00811, Redwood City v. Fleming 18UDL00812, Redwood City v. Reid 18UDL00818, and Redwood City v. Samuelson/Humphries 18UDL00820 are assigned for all purposes to Department 2, Honorable Marie Weiner. Pursuant to CRC Rule. 3.300(h)(1)(A), this Court is empowered and authorized to “determine whether the cases must be ordered related and assigned to his or her department”.
