COMES NOW, Bayview LOAN SERVICING, L.L.C. (“Bayview”), Plaintiff in this cause,
and files this its Motion for Judgment Nune Pro Tune, or in the Alternative, Motion to Modify
Judgment (the “Motion’) asking the Court to sign a judgment nunc pro tunc under the authority
of Rule 316 of the TEXAS RULES OF CIVIL PROCEDURE, or to modify the Judgment, and would
respectfully show the court as follows:

A. FACTS
1. Bayview filed its Amended Motion for Default Judgment on November 5, 2008, secking
judgment against Defendant KIAN TAVASOLI (“Tavasoli”).
2. On or about November 6, 2008, the Court signed and entered a Final Default Judgment in
favor of Bayview, and against Defendant Tavasoli.
