SUPERIOR COURT OF CALIFORNIA, COUNTY OF LOS ANGELES Civil Division Central District, Stanley Mosk Courthouse, Department 52 19STCV31058 October 13, 2020 GABRIEL FLORES vs MEDICALI HOLDINGS, INC. 9:30 AM Judge: Honorable Susan Bryant-Deason CSR: None Judicial Assistant: Ben Del Barrio ERM: None Courtroom Assistant: Tony Isunza Deputy Sheriff: None APPEARANCES: For Plaintiff(s): Justin B. Toobi (Telephonic) For Defendant(s): Alan N. Goldberg (Telephonic) NATURE OF PROCEEDINGS: Hearing on Motion to Tax Costs Matter is called for a hearing. The Court reads its tentative ruling in open court. Matter is argued. The court having read the papers and heard the arguments rules as follows: PLAINTIFF’S COUNSEL JUSTIN TOOBI’S MOTION TO STRIKE AND/OR TAX POST- JUDGMENT COSTS On July 10, 2020, the Court ordered plaintiff’s counsel Justin Toobi to pay $3,510 in sanctions within 10 days under CCP § 2023.030(a) for unsuccessfully opposing defendants’ motion to quash subpoenas. On August 18, defendants Medical Holdings Inc. and Charles Weinberger filed a Memorandum of Costs After Judgment seeking $40 for issuing a writ of execution on August 3, $40 for levying officer fees on August 11, $2,135 in attorney fees incurred from August 3 to August 18, and $14.40 in accrued interest, for a total of $2,229.40. Standing to Make Motion Though this motion was initially brought by plaintiff—not plaintiff’s counsel Justin Toobi, the judgment debtor—the Notice of Errata filed on October 6, 2020 sufficed to correct that error.
