SMALL CLAIMS DOCKET TO THE CIVIL DOCKET
Now on this 12th day of _June 20.23 the Court having heard
the Defendant's Motion to Transfer, as permitted in 12 Oklahoma Statutes, Section 1757,
finds the Motion to Transfer is proper and orders this case transferred to the Civil Docket
IT IS THEREFORE ORDERED that this case be and the same is hereby
transferred from the Small Claims Docket to the Civil Docket of this Court.
IT IS FURTHER ORDERED that the Defendant as movant shall file and pay for
this Order of Transfer within ten (10) days of the date of this order. If the Defendant does
not file this transfer order within ten (10) days, the case shall be reinstated to the small
claims docket upon motion of the small claims Plaintiff, and no further transfer shall be
authorized. Before the transfer is effected, the Defendant shail deposit with the Clerk the
court costs that are charged in other civil cases under Section 151 through 157 of Title
28 of the Oklahoma Statutes, less any sums that have already been paid to the Clerk.
After this filing, the costs and other procedural matters shall be governed as in other civil
actions, and not under the small claims procedure
The Plaintiff shall file a petition that conforms to the standards of pleadings
prescribed by the Oklahoma Pleading Code within twenty (20) days of the date the
transfer order is signed. The Answer of the Defendant shall be due within twenty (20)
days after the filing of the Petition and the Reply of the Plaintiff shall be due within ten
(10) days after the answer is filed. _

MOTION TO TRANSFER
Come now Haynes Reynolds and 788 Investments, LLC, defendants herein, and requests
this matter now pending on the Small Claims Docket be transferred to the Civil Docket of said
Court, as permitted by 12 Oklahoma Statutes, Section 1757. The reason for this request is
Defendants need the opportunity to exchange discovery. This case involves a payment dispute
alleging failure to pay for supplies on open account and will require written discovery and possible
depositions of the parties.
This matter is presently scheduled for Small Claims hearing on the 12" day of June, 2023,
at 9:00 A.M. and the Defendant’s Motion to Transfer will be heard at that time.
Deposited herewith are the required non-refundable $50.00 court costs. Defendants will
provide actual notice of such Motion to Transfer by mailing a copy of said Motion to the Plaintiff
