COMES NOW, the Defendant, Kenneth Sam, Sr., (“Defendant”), by and through his
attorney of record G. Gene Thompson, Esq., Keri D. Palacios, Esq., and Charles C. McCaskey,
Esq. of CREEK COUNTY LAW, P.L.L.C., and moves the Court to transfer this action from the small
claims docket to the civil docket of the District Court, or in the alternative requests a continuance
of this matter currently set for August 15, 2023. In support of this Motion, Defendants state as
follows:
1 This Motion is made on the grounds that the Defendant Kenneth Same were served
with a Small Claims Affidavit in the above-captioned small claims matter (hereinafter the
Affidavit”). A copy of the Affidavit and Order are attached as Exhibit A.
2 The Affidavit commands the Defendants appearance on August 15, 2023 at 1:30
p.m. at the Creek County Courthouse.
3 The Affidavit alleges, “The defendant is indebted to the plaintiff in the sum of
$6116.03 for truck damage.”
4 Defendants deny the allegations contained in the Affidavit.
5 Defendant has timely filed this Motion and deposited with the Court Clerk the sum
of $50.00.

6 Based upon information and belief, the truck had no motor, no transmission,
was already severely damaged.
Argument
& Authority
Pursuant to 12 O.S. 1757(A), the small claims court judge has the discretion to transfer
an action to another docket of the District Court. The Motion to Transfer is heard on the trial date.
12 Okla. State. §1757(B). In ruling on the Plaintiff's Motion to Transfer, the judge should consider
the hardship to the Plaintiff, the complexity of the case, the reason for transfer, and other relevant
matters. Id. Accordingly, Defendant requests the Court transfer this matter to another docket of the
District Court.
This case will need to involve an examination of the truck to determine its value when it
was damaged. It will further require that discovery will need to be done into the exact facts of the
case as the Defendant is being sued in his personal capacity. Here, Plaintiffs requests that the
Court transfer this matter to another docket of the District Court in order to allow Plaintiff the
opportunity to conduct discovery
Conclusion
WHEREFORE, Defendant Kenneth Sam, Sr., respectfully requests this Court to Transfer
this matter to another docket of the District Court. A proposed Order Transferring the Case and
Consolidating it has been submitted herewith, and a copy is attached as Exhibit C.

ORDER TRANSFERRING ACTION FROM SMALL CLAIMS COURT
TO DISTRICT COURT
THIS MATTER comes before the Court upon the Motion to Transfer Action From Small
Claims Court (“Motion”) by, Kenneth Sam, Sr., (“Defendant”), by and through his attorney of
record G. Gene Thompson, Esq., Keri D. Palacios, Esq., Rachel L. Farrar, Esq., and Charles C.
McCaskey, Esq. of Creek County Law, P.L.L.C., for an Order of this Court transferring this action
from the small claims docket to the civil docket of the District Court. The Court, upon review of
the files and records in this case being otherwise fully advised in the premises finds and orders as
follows:
1 This action should be transferred to the “CS” or “CJ” civil docket of the District
Court to allow Defendant to conduct discovery with regards to Plaintiffs claim and assert
counterclaims that are not limited to a dollar amount.
