                  Marisa Rice provides this unsworn declaration in lieu of an affidavit, as allowed

           under Rule 80(c), Ariz. R. Civ. P., and says as follows:

                  1.     I make this Declaration in support of the Pima County Regional Flood Control
     21
           District’s Application for Preliminary Injunction and Application for Order to Show Cause
     22
           in the above-entitled matter.

                  2. I am employed         by the (the “District”). I am responsible for managing the
     24
           District’s open space lands and investigation of encroachments onto District-owned land.
     25
                  3. Imake this Declaration based upon my review of the District’s property records
     26
           and upon my own knowledge and observations.
