COMES NOW Plaintiff, Denver West Village, L.P., ("Plaintiff") and files this proof
of mailing under §35.004(b)(2) of the Texas Civil Practice & Remedies Code.
On June 24, 2022, Plaintiff mailed the Notice of Filing of Foreign Judgment and
Affidavit of Names and Addresses in this case to Judgment Debtor, SWH Mimi’s Café,
LLC, at its last known address according to the Texas Secretary of State of 18872
MacArthur Blvd., Ste. 400, Irvine, CA 92612, via certified mail, restricted delivery. The
correspondence was returned stating “Not Deliverable as Addressed/Unable to Forward”
on June 29, 2022.
On June 24, 2022, Plaintiff mailed the Notice of Filing of Foreign Judgment and
Affidavit of Names and Addresses in this case to Judgment Debtor, SWH Mimi’s Café,
LLC, at its last known address according to the Texas State Comptroller of 12201 Merit
Drive, Suite 900, Dallas, Texas 75251, via certified mail, restricted delivery. The
correspondence was returned stating “Forward Time Expired/Return to Sender” on July
13, 2022.
On June 24, 2022, Plaintiff mailed the Notice of Filing of Foreign Judgment and
Affidavit of Names and Addresses in this case to Judgment Debtor, SWH Mimi’s Café,
LLC, to its registered agent in the state of Texas, CT Corporation System, 1999 Bryan
St., Ste. 900, Dallas, TX 75201-3136 via certified mail, restricted delivery. The

correspondence was delivered to the registered agent on July 7, 2022.
Attached to this Proof of Mailing as Exhibit A and incorporated herein by reference
are the documents reflecting the above mailings.

JUDGMENT
THIS MATTER comes before the Court on Plaintiff DENVER WEST
VILLAGE, L.P.’s, Motion for Default Judgment against Defendant SWH MIMI’S
CAFÉ, LLC. The Court having been fully advised, hereby GRANTS the Motion and
ENTERS JUDGMENT as follows:
1. Judgment enters in favor of Plaintiff DENVER WEST VILLAGE, L.P.,
and against Defendant SWH MIMI’S CAFÉ, LLC, pursuant to C.R.C.P. 55(b) and
C.R.C.P. 121, Section 1-14 in the total amount of $769,291.21, plus interest as
described below. The amounts due before the inclusion of pre- and post-judgment
interest are:
a. Damages based on rents: $ 764,653.24
b. Attorney’s fees $ 4,181.00
c. Costs $ 456.97
2. These damages based on rents are subject to the addition of pre- and
post-judgment interest pursuant to C.R.S. section 5-12-102(1)(a), at the statutory
rate of 8% compounding annually from January 25, 2021.
3. Plaintiff may amend the judgment in its favor to include attorney fees
and costs expended in the future related to collections and enforcement of the his
judgment.
4. Pursuant to C.R.S. sections 13-51-101 et seq. and C.R.C.P. 57, the
Court declares Defendant has voluntarily abandoned the Premises and any
personal property located thereon as contemplated by C.R.S. sections 38-20-101 et
seq. and 13-40-101 et seq.

TO THE HONORABLE JUDGE OF SAID COURT:
NOW COMES Plaintiff, Denver West Village, L.P., and files this Notice of Filing of
Foreign Judgment and supporting affidavit.
1. This Notice of Filing of Foreign Judgment is given under §§35.003 and
35.004 of the Texas Civil Practice and Remedies Code.
2. Plaintiff is a Delaware limited partnership with its principal office address at
225 W. Washington St., Indianapolis, Indiana, 46204.
3. Defendant, SWH Mimi’s Café, LLC, is a California limited liability company
with a principal office address, according to the Texas Secretary of State, of 18872
MacArthur Blvd., Ste. 400, Irvine, CA 92612. According to the Texas State Comptroller,
the principal office address of SWH Mimi’s Café, LLC is 12201 Merit Drive, Suite 900,
Dallas, Texas 75251. The registered agent for SWH Mimi’s Café, LLC in the state of
Texas is CT Corporation System, 1999 Bryan St., Ste. 900, Dallas, TX 75201-3136.
4. On January 31, 2022, in a case styled Denver West Village, L.P. v. SWH
Mimi's Cafe, LLC, the District Court of Jefferson County, Colorado, in Cause
2021CV31133, entered a Judgment in favor of Plaintiff and against Defendant. A true
and correct copy of the Judgment is attached to this Notice as Exhibit A.

5. The Judgment awards Plaintiff a judgment in the principal amount of
$764,653.24, plus attorneys' fees of $4,181.00, plus costs of court in the amount of
