Defendant Exceptional Motorcar, LLC, by and through undersigned counsel, moves this
Court to (a) transfer venue, (b) dismiss the Complaint, and/or (c) order a more definite statement
As outlined in the memorandum in support, Plaintiff's complaint is deficient for a number of
reasons, including but not limited to (a) being filed in an improper venue, (b) failing to attach a
necessary party, and (c) failing to attach a full written account on which their claim is founded.
For these reasons, Defendant requests this Court to transfer venue to Defiance County or
Franklin County, dismiss the case for failure to join a necessary party — namely, Columbus Fair
Auto Auction, and failure to atfach a complete aécount or written statement in compliance with
Civ. R 16(D)(1).

IMPROPER VENUE
SEs
Venue is property in “(1) the county in which the defendant resides; (2) the county in
which the defendant has his or her principal place of business; (3) the county in which the
defendant has conducted activity that gives rise to the claim for relief; (4) a county in which the
property, or any part of the property, is situated if the subject of the action is real property or
tangible personal property; (5) the county in which all or part of the claim for relief arises; (6) in
actions under Ohio’s long-arm statute, tlie county Whiere the plaintiff resides; (7).if there is no ihee
available forum, the county in which the plaintiff resides, has his or her principal place of
business, or regularly and systematically conducts business activity.” Starks v. Choice Hotels
Int'l, 175 Ohio App. 3d 510. There must be “significant activity” in the county, rather than
“random with defendant” in order to be proper venue. Baggaley v. Holiday Motors IH, 1993 Ohio
App. LEXIS 6207, citing Grange Mut. Ca. Co. v. Thompson, (1990), 61 Ohio App.3d 190.
None of the alleged wrongs happened in Fairfield County. All of the alleged wrongs occurred in
Franklin County where the sale took place.
Here, Defendant’s principal place of business is at 20891 Co Rd 424, Defiance, Ohio.
