MOTION TO CHANGE VENUE
Plaintiff, Mark Johnson moves that this Court transfer this case to the appropriate county,
Madison. The proper jurisdiction and venue of this case, as well as the power to transfer this
case is set forth in R.C. 4123.512(A). The reason for this request is that the injury did not occur
in Franklin County, Ohio but in Madison County. The grounds for this motion are more fully set
forth in the accompanying Memorandum in Support

MEMORANDUM IN SUPPORT
This is a workers’ compensation appeal made pursuant to R.C. 4123.512. R.C. 4123.512
provides that a claimant or employer may appeal a decision in any injury or occupational disease
case, other that a decision as to the extent of disability, to the court of common pleas of the county
in which injury was inflicted, or in which the contract of employment was made if the injury was
made outside the state, or in which the contract of employment was made if the exposure occurred
outside the state. If the action commenced in a court of a county other than a court of a county
having jurisdiction over the action, the court, upon notice by any party or upon its own motion, shall
transfer the action to a court of a county having jurisdiction. Unlike most civil actions, venue in a
workers’ compensation case is jurisdictional. Hartsock v. Chrysler Corp., et al. (1989) 44 Ohio
St.3d 171, 541 N.E.2d 1037
Venue is proper in Madison County, as this is where the injury occurred. (Exhibit A FROT;
Answer of Defendant Bodycote Thermal Processing, Inc. Paragraph 7). Therefore, Plaintiff
moves this court to transfer this case, as the Court lacks subject matter jurisdiction, because the
injury occurred in Madison County. Should the court look favorably on this motion, an entry is
attached.
