Said Original Petition for Partition of Real Estate and Motion for Service by Posting Pursuant to Tex R.Civ.P.109a was filed in said court on this the 21st day of August, 2018, in this case, numbered 18-08-11095-CV on the docket of said court. of the parties to the cause are as follows: Tomplait is Plaintiff and Unknown Heirs of Lou McCleskey; Unknown Heirs of Leona McCleskey Young; Unknown Heirs of Maurice McCLeskey; Unknown Heirs of Marion McCleskey; Unknown Heirs of Carolyn McCleskey Roy; Unknown Heirs of Richard McCleskey statement of the nature of this suit is as follows, to wit: Plaintiff, Eddie Ruth Tomplait, is suing Defendants, the Unknown Heirs of Lou McCleskey,Unknown Heirs of Leona McCleskey Young, Unknown Heirs of Maurice McCleskey, Unknown Heirs of Marion McCleskey, Unknown Heirs of Carolyn McCleskey Roy, and Unknown Heirs of Richard McCleskey, for partition by sale of the following described real estate: tract of land in the Finley McNaughton Survey (A-392) of Montgomery County, Texas and being the same tract of land described in a General Warranty Deed dated June 24. 1994 and recorded at Instrument No. 9435406 of the Real Property Records of Montgomery County, Texas, and being more particularly described by metes and bounds as follows: Beginning at a stake which is the northeast corner of Tract “1” from which the northeast corner of Lot 19 of a Subdivision of the McNaughton Survey recorded in Vol. 92 at Page 238 of the Deed Records of Montgomery County, Texas bears North 89 degrees 52 minutes 05 seconds west for a distance of 385 feet along the center line of a 30-ft. road; Thence North 89 degrees 52 minutes 05 seconds West, a distance of 606.53 ft. along the said centerline to a point for corner; Thence South 00 degrees 07 minutes 55 seconds West, a distance of 13.53 feet deeded for right of way to a point for corner as the Place of Beginning at the northeast corner of the described tract; Thence South 00 degrees 07 minutes 55 seconds west a distance of 240.86 feet to a point for corner as the southeast corner of the described tract: Thence North 89 degrees 52 minutes 05 seconds west, a distance of 150.00 feet to a point for Thence North 00 degrees 07 minutes 55 seconds East a distance of 240.86 feet to a point for corner; Thence South 89 degrees 52 minutes 05 seconds East a distance of 150 feet to the Place of Beginning, and containing approximately 0.829 acres of land, more or less (the “Property”).
