AMIR MIRESKANDARI’S NOTICE OF
FILING DEPOSIT IN LIEU OF BOND
Defendant Amir Mireskandari submits notice to the Court of the deposit made in
lieu of bond to the District Clerk of Dallas County, State of Texas.
On Thursday, July 20, 2023, Mireskandari timely filed his Motion for Judgment
Notwithstanding the Verdict, Motion for New Trial and Motion to Modify the Judgment.
On Thursday, July 20, 2023 and Friday, July 21, 2023, Mireskandari’s counsel
attempted to tender the money judgment of $75,000.00 plus one month’s interest as
payment in full of the total compensatory damages. Of course, in a typical effort to
increase the costs of litigation, Plaintiffs counsel rejected that offer.
On Friday, July 21, 2023, Mireskandari filed a supersedeas cash bond via Wire
transfer in the total amount of $79,274.81, which includes the $7 5,000.00 judgment
amount, plus thirteen (13) months of interest calculated at annual interest rate of
5.25%.1 See Exhibit A. The trial court clerk has approved the bond. This deposit satisfies
the necessary requirements of Texas Rule of Appellate Procedure 24.1(a)(3), rendering
the judgment superseded and any further enforcement attempts — or discovery related
to enforcement —
improper. See Tex. R. App. P. 24.1(f) (“Enforcement begun before the

judgment is superseded must cease when the judgment is superseded”); Midani V.

been suspended by a supersedeas bond”).
