SANCTIONS AGAINST DEFENDANT MAKE WAY CONSTRUCTION, LLC
THIS CAUSE, having come before the Court on Plaintiff’s Motion for Discovery
Sanctions against Defendant (“Motion”), and the Court, having reviewed the said Motion; having
conducted a hearing on September 26, 2023, by Counsel for Plaintiff; and being otherwise fully
advised in the premises, it is
ORDERED AND ADJUDGED as follows:
1. ORDERED that Defendant shall, within thirty (30) days from September 26, 2023,
provide responses to Plaintiff’s First Set of Interrogatories and Requests for Production;
2. ORDERED that Defendant’s failure to comply with this Order and to provide
responses to Plaintiff’s First Set of Interrogatories and Requests for Production will result in the
striking of Defendant’s Answer and Affirmative Defenses.
3. ORDERED that this Court GRANTS Plaintiff’s entitlement to sanctions pursuant
to Fla. R. Civ. P. 1.380 for attorney’s fees and costs and reserves as to amount to be adjudicated
upon a separate motion from Plaintiff.
