                                                     DECISION AND ORDER


                      This case is before the Court on Plaintiff Tremain Hogan’s (Hogan) Motion to Withdraw

            Complaint.       Hogan’s motion asks the Court to withdraw his complaint so that he can file it in the

            Ohio Court of Claims.

                      Though not labeled so, the Court views Hogan’s motion as a notice of voluntary dismissal

            without prejudice made pursuant to Civ.R.          41(A)(1)(a) or a motion to dismiss the case without

            prejudice under Civ.R. 41(A)(2).          The Court finds that Hogan’s motion is well-taken, and it is

            GRANTED.             Hogan’s claims are dismissed without prejudice. The Clerk shall terminate this case

            from the Court’s active docket.         Defendant Rodney Howell’s August 29, 2023 Motion to Stay

            Discovery and August 11, 2023 Motion to Dismiss are MOOT.

                      IT IS SO ORDERED.
