In anticipation of the Case Management Conference, counsel for the parties should be prepared to discuss at the hearing and file written case management conference statements (in prose and details, not using the standardized Judicial Council form) with a courtesy copy delivered directly to Department 2 on or before November 29, 2022, as to the following: . a. Status of Discovery in preparation for the Phase Two Inverse Condemnation Trial; Which Plaintiffs still have pending claims (i.e., have no settled); Status of Settlement or Mediation; Whether the trial will proceed as a jury trial or court trial, including’ consideration that, if a Court Trial, the Court would be able to use all prior trial evidence from Phase One, and thus avoid duplication; Anticipated length of the Phase Two Trial; Any anticipated motions and proposed briefing schedule; Setting of next CMC date; and Any other matters for which the parties seek Court ruling or scheduling.
