may be incurred in the future by reason of conditions which were
in existence as o~ or prior to the date of vesting of title and
paysession pursuant to nT.J.S,A. 2d:3-19. Plaintiff further
reserves the right ~a seek, ~.t its sale di~~retion, any and all
available J.~gal., administrative and equitably r~medie~ to compel
defendants ~o reme~iate and/or c~.ean up the properly in
acca~dance with applicable state and ted~ral statutory and

8. Plaintiff has paused the subject property to be
inspected for the existence of contamination andjo~ solid waste
and has found nv indication of contamination andjor solid waste
which would require that further investigation ar other
af~irma~ive action be undertaken in accordance with New Hersey
Department of Enviranm~ntal Protection guidelines and
regula~~~ns. Plaintiff has pr~vi~ed na.tice ~a the owner of
record of tie property as t~ the results flf the ab~ve~re~erenc~d
inspection ~E~hibi~ C). The owner of record hay not pravidea to
Plaintiff any information that would necessitate further
investigation ~f the subject property. However, due to the
present use of the subject properly, ids en~ir~nmental history,
and/or the presence of und~rgraund storage tanks and/ar piping,
there exi~t~ a reasonable possibility that ~her~ may be some
hype of contamination which may require further investigation
and/or ~emediati~n.
Notwithstanding the results of Plaintiff's inspection,
Plaintiff does not adept liability far any pre-existing
contamina~ian or solid waste, whether now ~~~wn ar subsequently
dis~o~~red. ~ur~hermo~e, P1ain~iff has valued the prfl~erty as
if it hay been remediated in accQrdance~ with applicable
regulatory requirements and subject to the imp~si~ion of any
c~n~itions a~ to use except as noted in the appraisal and
subject to paragraph 7 above. Plaintiff reserves the right to
amend the complaint i~ additional o~ higher levels of

remaining on deposit until additional or higher levels of
contamination are remediated and/or cleaned up by the owner of
record or until any solid waste is properly removed or closure
is performed by the owner of record in accordance with
applicable state and federal ~tandard~, and to move for .any
other relief, including administrative relief, which may be
nece~~ary to protect Plaintiff's rights end interests.

Raceway Realty, LLC, a New Jersey Limited Liability company,
