MOTION TO TRANSFER CASE TO SUPERIOR COURT
BUSINESS LITIGATION SESSION IN SUFFOLK COUNTY
Defendant/Counterclaim Plaintiff Jonathan Molleur (“Mr. Molleur”) hereby moves
pursuant to Superior Court Administrative Directive 17-1 and M.G.L. ch. 223 § 13 for an order
transferring this case to the Massachusetts Superior Court Business Litigation Session in Suffolk
County. In further support of this Motion, Mr. Molleur states as follows:
1 This case involves the falling out between two former law partners and the related
dispute over the dissolution of their law firm, Advocates Legal Group (“ALG”). The claims at
issue involve, among others, breaches of fiduciary duty, accounting, fraud, misrepresentation,
and interference with business and contractual relationships. Mr. Molleur anticipates that a trial
of this matter will likely involve numerous expert witnesses on topics including fiduciary duties
owed between partners and proper accounting practices.
2. The partnership dispute and claims at issue relating to the liability and obligations of
partners and the governance and internal affairs of a partnership are appropriate claims to be
accepted into and heard by the perior Court Business Litigation Session. See Superior Court
