                       CONSOLIDATION ORDER AND NOTICE OF STATUS CONFERENCE

                     This matter comes before the Court on Plaintiff's Motion for Consolidation.    Pursuant to

            Civ. R. 42(A) and Loc.R.31.02(E), a party may file a motion to consolidate when cases involving

            common questions of law or fact are pending before different trial judges. Plaintiff contends that

            these two actions arise from the same set of facts, involve common questions of law, and involve

            the same care and/or treatment rendered to decedent Michael E. Minshali. Plaintiff argues that the

            nature of the claims and defenses in both cases, and the goals of promoting judicial economy and

            avoidance of potentially conflicting results warrant consolidation of the two cases into one action.

                     The Court agrees. Accordingly, the Court finds the Motion to Consolidate well-taken and

             it is hereby GRANTED.
                     For the foregoing reasons, Case No, 23-CV-8892 is hereby consolidated with the earlier

             filed Case No. 22-CV-8623, before Judge Lynch, and thereafter the combined cases should

             proceed through discovery and trial together, adopting the case scheduling order in the second

             filed case.   All subsequent pleadings shall bear the complete captions and case number of each

             consolidated case and shall be filed in each case.
