COMPLAINT COUNT ONE 1. Plaintiff is entitled to enforce a note, the original of which is in plaintiff's possession. A copy of the note is attached hereto as Exhibit A. 2. The note has been modified in part by a certain loan modification agreement executed by the parties. A copy of the loan modification agreement is attached hereto as Exhibit B. 3. There has been a default under the terms of the note and loan modification agreement; plaintiff has performed all conditions precedent; and plaintiff has accelerated the debt. 4. There is due to plaintiff, M&T Bank, from the defendant, Rachel L Johnson, II a/k/a Rachel L Johnson, upon the note, the sum of $51,499.27, with interest at the rate of 7.125% per year from August 1, 2023, plus court costs, advances, and other charges as allowed by law. COUNT TWO 5 Plaintiff incorporates the allegations of Count One and further states that the note is secured by a mortgage, a copy of which is attached hereto as Exhibit C. The mortgage is a valid first lien upon the real estate described therein. 6. The mortgage was filed for record on December 2, 2003, as Instrument Number 200312020382321, of the county recorder's records and it was subsequently assigned to the Plaintiff. The conditions of defeasance contained therein have been broken; plaintiff has complied with all conditions precedent; and plaintiff is entitled to have said mortgage foreclosed. Plaintiff says that the defendant, Unknown Spouse of Rachel L Johnson, Il A/K/A Rachel L Johnson, may claim an interest in the subject property as the current spouse of the defendant-titleholder, Rachel L Johnson, II A/K/A Rachel L Johnson 9. Defendant, Franklin County Treasurer, may claim an interest in the subject property by virtue of property taxes due. 10. Plaintiff says that the defendant State of Ohio, Department of Taxation may claim an interest in the property by virtue of the following State Tax Liens. a. filed for record on December 7, 2011 in Instrument Number 11 JG 12 49049; AND b. filed for record on December 10, 2021 in Instrument Number 21 JG 103954 11. Plaintiff says that the defendant City of Columbus, Ohio may claim an interest in the property by virtue of a Lis Pendens filed for record on June 30, 2023 in Instrument Number 202306300064920 of Franklin County Recorder's Records 12.
