TO FILE RESPONSES TO PLAINTIFF’S MOTION TO DISMISS
PCNA’S COUNTERCLAIM AND MOTIONS TO STRIKE
DEFENDANTS’ AFFIRMATIVE DEFENSES
Defendants PORSCHE CARS NORTH AMERICA, INC. (“PCNA”) and PORSCHE
LATIN AMERICA, INC. (“PLA,” together with PCNA, “Defendants”), by and through
undersigned counsel, hereby respectfully request that this Court enter an order granting an
additional 14-day extension of time to respond to Plaintiff The Collection’s Motion to Dismiss
Defendant PCNA’s Counterclaim, Motion to Strike Defendant PCNA’s Affirmative Defenses, and
Motion to Strike Defendant PLA’s Affirmative Defenses, filed February 28, 2024, to and including
April 29, 2024. As good cause therefor, Defendants state:
1. On January 5, 2024, Defendant PCNA filed its Answer and Defenses to The
Collection LLC’s Complaint and Demand for Jury Trial and Counterclaims, and Defendant PLA
filed its Answer and Defenses to The Collection LLC’s Complaint and Demand for Jury Trial.
(Dkt. 74; Dkt. 75.)

2. On February 28, 2024, Plaintiff filed its Motion to Dismiss Defendant PCNA’s
Counterclaim, Motion to Strike Defendant PCNA’s Affirmative Defenses, and Motion to Strike
Defendant PLA’s Affirmative Defenses. (Dkt. 83; Dkt. 88; Dkt. 89.)
3. On March 6, 2024 Defendants filed an Unopposed Motion for Extension of Time
to File Responses to Plaintiff’s Motion to Dismiss PCNA’S Counterclaim and Motions to Strike
Defendants’ Affirmative Defenses, requesting a 35-day extension of the deadline by which to
respond to Plaintiff’s Motion to Dismiss and Motions to Strike. (Dkt. 92.)
4. On March 8, 2024, the Court entered an Order granting Defendants’ Unopposed
Motion for Extension of Time. (Dkt. 94.) Defendants’ current deadline to respond to Plaintiff’s
Motions is therefore April 15, 2024. (See Dkt. 94.)
5. Since the Court granted Defendants’ Unopposed Motion for Extension of Time,
Plaintiff and Defendants have agreed that they would each be filing amended pleadings. The
parties have further agreed that those amended pleadings would obviate the need to brief Plaintiff’s
Motions directed at the current pleadings (although Plaintiff has informed Defendants that it
reserves the right to file renewed motions after reviewing Defendants’ amended pleadings).
6. Therefore, in an effort to avoid the time and expense of briefing the Motions that
will be mooted by the amended pleadings, Defendants seek a short two-week extension to give the
parties time to finalize and file their amended pleadings.
7. Counsel for the parties have conferred, and Plaintiff does not oppose the requested
extension of time.
8. The extension is not sought for any improper purpose, will not prejudice any of the
parties to this action, and will not unduly delay this action.

WHEREFORE, Defendants PORSCHE LATIN AMERICA, INC. and PORSCHE CARS
NORTH AMERICA, INC. respectfully request that this Court extend the time to respond to
Plaintiff’s Motion to Dismiss Defendant PCNA’s Counterclaim, Motion to Strike Defendant
PCNA’s Affirmative Defenses, and Motion to Strike Defendant PLA’s Affirmative Defenses by
14 days, to and including April 29, 2024.
