COST OR APPEAL BOND
COMES NOW LVNV Funding LLC, Plaintiff, and contests Defendant’s Statement of
Inability to Afford Payment of Courts Costs or an App‘eai" Bond (“Statement”) presented by
Defendant Michael I Morgan, and in support thereof would show the court the following:
Defendant has failed to provide prima facie evidence pursuant to TRCP 145(d) of the
Inability toAfford Payment of Costs and failed t0 provide evidence that they:
1. receive benefits from a means-tested government entitlement program;
2. are represented by an attorney who is providing legal services through a provider
funded by the Texas Access to Justice Foundation, a provider funded by the Legal
Services Corporation, or a nonprofit that provides civil legal services to persons
living at 0r below 200% of the federal poverty guidelines published annually by the
United States Department 0f Health and Human Services; g
3. have applied for free legal services through a provider as described directly above and
was determined to be financially eligible but was declined representation in this case.
For the reasons stated above, Plaintiff challenges the applicability and veracity of the
Defendant’s Statement and requests a hearing be set t0 determine Defendant's financial ability to
afford costs on appeal. Plaintiff further prays for any further relief at law or equity to which it
may be justly entitled.
