Comes now the Plaintiff, ARVEST BANK (“Plaintiff”), and for its cause of action
against the Defendant(s) alleges and states as follows:
1 That the Defendant(s) herein is a resident of Adair County, Oklahoma and
this Court has jurisdiction of the parties and the subject matter herein.
2 That the underlying obligations owed by the Defendant(s) to the Plaintiff
result from charges made by the Defendant(s) on a ARVEST BANK credit account.
3 That Defendant(s), Dylan T Benard, is indebted to Plaintiff for the sum of
$10,062.91.
4 ARVEST BANK is the lawful holder of the Account and Defendant(s) has
failed, refused, and neglected to pay the same after due and proper demand thereof.
5 Plaintiff has complied with all the terms, conditions, and provisions of the
account and is duly empowered to bring this action.
6 Plaintiff is entitled as a matter of law to a judgment in its favor and against
Defendant(s), Dylan T Benard, for the total amount remaining due such being $10,062.91,
a reasonable attorney’s fee, post-judgment interest allowed by Oklahoma law, and court

MOTION FOR EXTENSION OF TIME TO SERVE.
COMES NOW the Plaintiff, ARVEST BANK, by and through its counsel, Hood & Stacy, P.A.,
and for its Motion for Extension of Time to Serve, states and alleges as follows:
1 The above mentioned suit was filed on July 14, 2023. The deadline to exact service upon
Defendant(s), Dylan T Benard, is January 10, 2024.
2. Plaintiff has good cause for not yet having exacted service upon Defendant(s). Despite due and
diligent search, Plaintiff has been unable to locate Defendant(s) and has therefore been unable to
serve Defendant(s) and may not be able to do so before the time for exacting service expires on or
about January 10, 2024. Plaintiff's suit should therefore not be dismissed for lack of timely service
herein. See 12 O.S. § 2004(1) (providing that a suit shall not be deemed dismissed if Plaintiff can
show good cause for having failed to exact service within the requisite time period).
3 Granting Plaintiff an extension of time may allow for proper service of the pending process within
a reasonable period of time. Plaintiff therefore requests an additional 180 days in which to exact
service upon Defendant(s).
WHEREFORE, Plaintiff, ARVEST BANK, prays that this Court grants its Motion for Extension
of Time to Serve and allows Plaintiff an additional one hundred and eighty (180) days in which to serve
the Defendant(s), Dylan T Benard.

COMES NOW the Plaintiff, ARVEST BANK, by and through counsel, of Hood & Stacy, PA, and
for its Motion to Transfer Venue, hereby states and alleges as follows.
1. Plaintiff filed its Petition in the District Court of ADAIR County, Oklahoma on JULY 14, 2023.
2. Based on all information available to the Plaintiff at the time of filing the Petition, Plaintiff
was to file in ADAIR County, Oklahoma
3. Though Plaintiff cannot represent Defendant's county of residence with absolute certai nty,
after due and diligent inquiry, Plaintiff believes Defendant to be a resident of CHEROKEE
County, OKLAHOMA. As a result, Plaintiff requests that this matter be transferred.
4. Plaintiff does not make this request to cause delay, but to help move the case forward in
the proper venue
