MOTION FOR PROTECTIVE ORDER
Defendant, pursuant to Connecticut Practice Book § 13-5 hereby moves
for a protective order regarding the location of plaintiffs deposition. As noted in
the attached notice (Exhibit A), counsel noticed the defendant’s deposition on
April 11, 2024, for counsel’s office in Hartford to be taken on July 29, 2024.
The clear, unequivocal rule under Practice Book §13-29(a) provides that a party
may not be compelled to attend a deposition more than 30 miles from the party’s
residence. Here, the defendant resides at 187 Mechanic Street, Pawcatuck, CT
06379, which is 62.3 miles from defendant’s home. See Exhibit B- Google Map
Direction.
Accordingly, the undersigned respectfully requests that an order enter
prohibiting plaintiff from requiring the defendant to travel more than 30 miles
for her deposition.
