THIS CAUSE came before the Court on Plaintiff's Motion to Vacate the Final
Judgment of Mortgage Foreclosure, Dismiss Action without prejudice, Dissolve the Lis
Pendens, and Release Original Documents and the Court being fully advised in the
premises and reviewing the Court file, finds as follows:
A. A Final Judgment was entered herein on July 20, 2022,
B. Plaintiff claims that Defendant has since satisfied the Judgment under
Rule 1.540(b).
C. The Promissory Note and Mortgage were provided to the Court and the
Note was cancelled, extinguished and merged into the Final Judgment.
ORDERED AND ADJUDGED that:
1. Plaintiff Motion to Vacate Final judgment of Foreclosure entered on July 31,
2023, Dismiss the foreclosure action without prejudice and Dissolve the Lis Pendens is
hereby GRANTED.
2. The Final Judgment entered on July 31, 2023, 2023 is hereby VACATED.
3. The Case is dismissed without prejudice and the Lis Pendens is hereby
dissolved.
4. The Clerk is directed to release the original note and original mortgage to
Plaintiff's counsel at:De Cubas & Lewis, P.A.3313 W. Commercial Blvd Suite F-150 Fort
Lauderdale, FL 33309
