The Motion to Quiet Title is DENIED. Plaintiff improperly seeks to have the Court adjudicate this action
and enter a judgment in his favor without compliance with the procedural requirements for summary
judgment under Code of Civil Procedure Section 437c. Code of Civil Procedure Section 760.060 states
that the statutes and rules governing practice in civil actions generally apply to quiet title actions. Code
of Civil Procedure Section 760.030 merely permits the Court to apply the statutory provisions governing
quiet title actions to a dispute in which establishing or quieting title is at issue.
