HALLEY, ef al., Plaintiffs, Case No. 21 CV 1254 -Vs- Judge Page EMILY RAY, efal., Defendants, DECISION AND ENTRY ON DEFENDANT’S MOTION FOR CHANGE OF VENUE This case is before the Court on Defendant Emily Ray’s (Ray) motion for change of venue. The issues before the Court are: (1) whether Franklin County is a proper venue for this case; and (2) whether the Court should order that the case be transferred. For the reasons set forth in this opinion, the Court grants Ray’s motion. I. FACTS Plaintiffs filed their complaint on March 1, 2021. The complaint includes claims for negligence, negligence per se, loss of consortium, and for medical payments. This complaint is a nearly identical re-filing of case number 2018CV3091, which was first filed on July 5, 2018 in the Montgomery County Court of Common Pleas (MCCP). In 2018CV3091, a partial stipulation of dismissal was filed on December 4, 2018. It indicated that all controversies between Ray and Defendant CSAA General Insurance Company (CSAA) were resolved. The stipulation dismissed CSAA’s crossclaim against Ray with prejudice. On May 11, 2020 Plaintiffs voluntarily dismissed 2018CV3091 without prejudice pursuant to Civ.R. 41(A). The parties have completed some discovery in this case, and Ray has provided responses from CSAA to her first set of requests for admissions. Within those responses, CSAA admits: (1) Franklin County Ohio Clerk of Courts of the Common Pleas- 2021 Dec 02 8:40 AM-21CV001254 F725 - I26 that its principal place of business is not in Franklin County, Ohio; (2) that it paid $10,000 to or on behalf of Daniel Halley pursuant to the medical payment coverage portion of its policy; (3) that it was reimbursed for this $10,000 by Ray on or about December 4, 2019; and (4) that it has no remaining claim for subrogation or reimbursement against any party in this case. Ray’s motion argues that venue in Franklin County is not proper because the allegations and evidence in this case do not satisfy Civ.R. 3(C). Plaintiffs oppose Ray’s motion and argue that venue in Franklin County is proper because: (1) CSAA did business there; (2) CSAA’s claims are not fully resolved; (3) CSAA is not a nominal party; and (4) forum non conviens is not a recognized basis for intrastate venue transfer in Ohio. Il. VENUE The proponent of a motion to change venue bears the burden of demonstrating both that the current venue is improper and that the requested venue is proper under Civ.R. 3(C). Civ.R. 3(D)(1); Matthews v. D'Amore, 10th Dist. Franklin No. OSAP-1318, 2006-Ohio-5745, 58. Venue is proper under Civil Rule 3(C) in any one or more of the following counties: (1) The county where the defendant resides; (2) The county in which the defendant has his principal place of business; (3) A county in which the defendant conducted activity that gave rise to the claim for relief. Civ.R. 3(C)(1)-@). The alternative sections of Civ.R. 3(C) do not provide a sequential preference for priority among multiple permissible forums. Instead, the numerical provisions within Civ.R. 3(C) are on equal status, and any court specified therein may be a proper venue. Matthews at § 57 and LaBounty v. Big 3 Automotive, 6" Dist. Ottawa No. OT-18-022, 2019-Ohio-1919, § 29, citing Franklin County Ohio Clerk of Courts of the Common Pleas- 2021 Dec 02 8:40 AM-21CV001254 F725 - 7 Morrison vy. Steiner, 32 Ohio St.2d 86, 89, 290 N.E.2d 841 (1972). If multiple courts have proper venue, a plaintiff may choose where to bring the action. Matthews at 57. Here, Plaintiffs and Ray reside in Montgomery County. CSAA’s address in the complaint is within Franklin County. The alleged incident occurred on Wilmington Pike, within Montgomery County. These facts result in proper venue in Montgomery County pursuant to Civ.R. 3(C)(1) or (3). The only evidence offered to show CSAA’s principal place of business is their denial that it is in Franklin County. (CSAA Answers to Ray’s Request for Admissions, pg. 2) The Court is not persuaded by Plaintiffs’ argument that negotiations between the parties or their counsel created proper venue within Franklin County. (Memo Contra, pg. 6). Plaintiffs rely on Leading, which found no error in applying Civ.R. 3(C)(3) to find venue proper in the forum county where the defendant insurance company sent correspondence during negotiations to plaintiff's claims representative because “[rJesolution of the substantial issues herein will require a consideration of the negotiations conducted in part in Franklin County.” Grange Mut. Casualty Co. v. Leading, 10th Dist. Franklin No. 90AP-115, 1990 Ohio App. LEXIS 5408, * 15. There is no indication that Plaintiffs’ claim against CSAA in this case requires an in-depth analysis of settlement negotiations and whether they rise to the level of acknowledging liability as in Leading. Therefore, the Court does not find that venue is proper in Franklin County pursuant to Civ.R. 3(C)(2). As mentioned above, venue is proper within Montgomery County. Under this logic, whether CSAA is a “nominal” party under Civ.R. 3(F) is immaterial Since venue is not also proper in Franklin County under Civ.R. 3(C), Plaintiffs’ forum non conviens argument is inapplicable. See State ex rel. Smith v. Cuyahoga County Court of Common Pleas, 106 Ohio St.3d 151, 2005-Ohio-4103, 832 N.E.2d 1206, § 15, citing Chambers v. Merrell-Dow Pharms., 35 Ohio Franklin County Ohio Clerk of Courts of the Common Pleas- 2021 Dec 02 8:40 AM-21CV001254 F725 - I28 St.3d 123, 131, $19 N.E.2d 370 (1988) (applying forum non conviens principles only when a party requests to transfer a case properly venued in an Ohio county to another properly venued Ohio county.). Therefore, pursuant to Civ.R. 3(D)(1), and noting that Ray has timely asserted the defense of improper venue, the Court orders that this case be transferred to the Montgomery County Court of Common Pleas. (Answer, | 10). IIL. CONCLUSION After considering the motions, evidence, and arguments of the parties, the Court finds that Ray’s motion to transfer venue is well-taken, and is GRANTED. This case shall be transferred to the Montgomery County Court of Common Pleas. Plaintiff is ordered to pay the costs associated for this transfer pursuant to Civ.R. 3(D)(2). Ray’s request for attorney fees is DENIED. IT IS SO ORDERED. Copies to all parties. Halley was lawfully traveling northbound on Wilmington Pike, Kettering, Ohio, when the crash forming the subject of this Complaint occurred. This Complaint is re-filed in a timely fashion pursuant to Ohio Rev. Code. §2305.19. 2 Defendant Emily Ray, traveling from the opposite direction, negligently and recklessly operated a vehicle without reasonable control, changing multiple lanes, failing to yield the right of way, turning into oncoming traffic and colliding with a vehicle driven by Daniel J. Halley. 3 As a direct and proximate result, Mr. Halley is harmed and has incurred medical, hospital and rehabilitation expenses, lost wages and reduced earning capacity, and he has suffered personal injury, physical pain, mental suffering, disability and loss of enjoyment of life. 4 Daniel J. Halley will incur medical expenses and suffer physical pain, mental suffering, disability, reduced earning capacity and others harms and loss of enjoyment of life in the future. SECOND CLAIM FOR RELIEF (Negligence Per Se) 5 Plaintiffs repeat preceding paragraphs and state that defendant Emily Ray breached statutory duties to Plaintiffs and the general public under Ohio Revised Code §4511.43 and ordinance §432.16 of the City of Kettering, failing to yield the right of way to Mr. Halley. Said defendant’s conduct was negligent per se, resulting in harms and losses to Mr. Halley. Halley and Norma Halley have been married all the times pertinent to the Complaint and are damaged as a result of conduct described above. Plaintiffs have lost services, comforts, affection, consortium, love and joys of companionship with one another and will suffer losses of consortium in the future. FOURTH CLAIM FOR RELIEF (Medical Payments) 7 Plaintiffs repeat preceding paragraphs and state that CSAA General Insurance Company, d.b.a., CSAA Insurance Exchange (“CSAA”), and as AAA Insurance Company (“AAA”), is a business association located in Franklin County, Ohio, authorized to provide automobile liability and medical payments insurance coverages subject to laws and regulations of the State of Ohio. 8 Plaintiffs are insured persons under terms of a contract with CSAA, with a policy in effect on the date of the subject incident. Plaintiffs paid premiums and performed terms and conditions precedent to coverage. CSAA is obligated to confer medical payments insurance coverage with respect to the subject incident. However, coverage under Defendant Emily Ray’s liability policy is insufficient to fully compensate plaintiffs for damages resulting from the crash. Medical payments that were conferred must be adjudicated in accord with Ohio Revised Code §2323.44, and any CSAA claim for reimbursement or subrogation must be extinguished. Page 3 of 4 Franklin County Ohio Clerk of Courts of the Common Pleas- 2021 Mar 01 4:08 PM-21CV001254 OF419 - M5 WHEREFORE, Plaintiffs demand judgment against Emily Ray in an amount exceeding Twenty-Five Thousand Dollars as to each Claim for Relief to compensate for harms and losses, with judgment against CSAA in accordance with Rule 57 of the Ohio Rules of Civil Procedure and Ohio Revised Code §2323.44, §2721.02 and §3937.18, and terms and conditions of relevant contracts of insurance, together with costs of court, prejudgment and post-judgment interest, attorney fees and such other relief as may be deemed just and proper in equity or at law.
