In this motion, cross-defendants Arlette Gauze and Remy Sanouillet (“Sanouillets”) seek an order amending their judgment against Kaddu, Inc. a California Corporation (“Kaddu”) to add defendant Sujit Brar (“Brar”), the sole shareholder of Kaddu, Inc., as a judgment creditor.
I. Factual Background
This case has a long and protracted history. Arlette Gauze is the mother of plaintiff and cross-defendant, Sandrine Cornet. Ms. Guaze is married to Remy Sanouillet. Ms. Cornet worked at a restaurant in Mountain View and made efforts, individually and through her company, Opa Verde, to purchase the restaurant from Kaddu.
Cornet purchased the restaurant from Kaddu in late 2011 and paid $200,000 towards the purchase but purportedly abandoned the restaurant in October 2012. According to Brar, before Ms. Cornet missed rent payments and abandoned the restaurant, the landlord was willing to extend the lease for OPA VERDE.
