This is a class action alleging that defendants misclassified employees as independent contractors and committed other wage and hour violations.
Before the Court is plaintiffs’ motion for terminating or, alternatively, issue or evidence sanctions, as well as monetary sanctions, due to defendants’ asserted violations of several court orders. In this motion, plaintiffs also seek orders invalidating “the class notice” or, alternatively, 16 of the opt-outs received in response to the new round of curative notice to the class recently ordered by the Court, and compelling defendants to produce additional documents that have been the subject of discovery disputes between the parties. Defendants oppose this motion in all respects.3
