Nature of Proceedings: Petition for Writ of Mandate Petitioner Beth Anne Stewart alleges that she was employed by Morris and Smith, Inc. as a full-time caregiver from February 22, 2019 to April 19, 2019. Her employment ended when she was forced to resign after she reported violations of company policy and procedures that resulted in liability for elder abuse. Petitioner filed a claim for unemployment compensation benefits. The claim was denied by the California Employment Development Department on June 30, 2019, which found that petitioner’s resignation to be due to dissatisfaction with the terms of employment. Petitioner filed an appeal with California Unemployment Insurance Board and the administrative law judge affirmed the Department’s determination by decision dated August 15, 2019. Petitioner filed an appeal with the Board, which affirmed the administrative law judge’s decision on October 8, 2019. Petitioner has exhausted her administrative remedies.
