Background

This is an action premised on assault, battery, and unlawful distribution of drugs. Plaintiff Lina Vrendenburgh, in her capacity as successor in interest to Decedent, Kelly Marie Francis (Plaintiff), alleges that from 2015 until Decedents death on April 17, 2016, Defendant Rodney Francis (Defendant) provided Demerol and other dangerous drugs to Decedent on a daily basis causes the addition and physical dependence of Decedent.

On June 04, 2021, Plaintiff filed her Complaint alleging one cause of action for Assault and Battery.

On April 13, 2022, Defendant filed his Demurrer, subsequently sustained with Leave to Amend on May 11, 2022.

On May 26, 2022, Plaintiff filed her First Amended Complaint (FAC) alleging three causes of action for (1) Ultra Hazardous Activity, (2) Assault and Battery, and (3) Drug Distribution.[1]
