1.MOTION RE: BANKRUPTCY DISCHARGE
This the continued hearing of certain defendants’ Motion/Application regarding Bankruptcy Discharge.
The Court has considered the original papers and arguments, as well as the supplemental papers filed by Christine Stonger, specially-appearing at this time. Other parties have not filed supplemental papers.
The Court received the unrefuted and uncontested testimony of Ronald Lauter, Esq. averring that he did not represent Christine Stonger for the prior hearings, he could not appear on her behalf, he lacked authority to act on her behalf, and had never met nor spoken with the individual. Based on the unrefuted evidence, the Court will not determine that Christine Stonger has made a general appearance. As for the merits of this “Motion Regarding Bankruptcy Discharge”, the Court has indicated it is not a proper motion. The notice of motion does not make clear the specific order that is to be issued, and cite the relevant rule of procedu….....
