Defendants County of Orange (erroneously sued as “Orange County Board of Supervisors”) and Birgitt Walpus’ Demurrer to Plaintiff Larry William Karkkainen’s Complaint is sustained with 15 days leave to amend.
The parties are reminded that they must comply with the service provisions of Code of Civil Procedure section 1005. Otherwise, the Court may exercise its discretion to disregard any future, non-compliant papers.
This action arises from the alleged detention and placement into protective custody of Plaintiff’s minor son. The allegedly wrongful detention occurred from April 18, 2016 through June 22, 2016. Plaintiff’s Complaint includes causes of action for: (1) negligence; (2) false evidence (fraud); (3) intentional misrepresentation; (4) wrongful imprisonment; (5) retaliation; and (6) character defamation. Defendants demur to these claims on several grounds.
