1. Demurrer by Defendant Nissan North America, Inc. to First Amended Complaint:
Defendant Nissan North America, Inc. (“Defendant”) demurs to the 4th cause of action for fraudulent inducement/concealment and moves to strike Plaintiffs Emanuel Aguilera and Luz Aguilera’s (collectively “Plaintiffs”) claim for punitive damages in the First Amended Complaint (“FAC”).
For reasons set forth below, the Demurrer is SUSTAINED with leave to amend and the Motion to Strike is MOOT.
