Plaintiff’s Motion for Enforcement of Judgment and Order for Return of Property is DENIED.

Background

On March 2, 2012, Plaintiff Ivan Rene Moore (“Plaintiff”) filed a complaint against Defendant Kimberly Martin-Bragg (“Defendant”). On June 28, 2012, Plaintiff filed a First Amended Complaint for (1) trespass to chattels; (2) conversion; (3) negligence, and (4) violation of Civil Code 1965.

Plaintiff alleged that Defendant obtained a fraudulent judgment of possession of Plaintiff’s home in an unlawful detainer action. Further, after obtaining the judgment for possession, Plaintiff alleges that Defendant took control of certain personal properties belonging to Plaintiff. Defendant’s unlawful detainer judgment was later reversed in full by the Court of Appeal of California.
