1. Background Facts
Plaintiff, Luis Tisnado filed this action against Defendants, Hytrol Conveyor Company, Inc., Fletchline, Inc., and Florstor Engineering, Inc. for damages arising out of an incident that occurred when he reached his hand into a moving conveyor belt at his place of employment, OnTrac. Plaintiff noticed a bottle spinning in the gap on the conveyor belt at a two-pulley hitch, and climbed onto the belt to try to remove the bottle. His arm was pulled inside the gap at the hitch and he sustained injuries.
Plaintiff’s employer, OnTrac, is not a party to this action. OnTrac hired Defendant, FloStor to design and build the subject conveyor system. Hytrol designed and manufactured the conveyor system component parts, including the two-pulley hitch. FloStor hired Moving Defendant, Fletchline to install the
