#5 – Duboff v. Schermer, et al. (BC617750); In re Samuel Schermer and Lucille L. Schermer Inter Vivos Trust (BP163594)

On October 19, 2017 this court considered and denied the CRC 3.300(h)(1)(D) motion to relate civil law case BC617750 with probate law cases BP163594 and BP161462, which motion was filed by case BC617750 defendant Linda Schermer, individually; as trustee of the Surviving Trustor’s Trust under the Schermer Family Trust; as trustee of the Deceased Trustor’s Trust under the Schermer Family Trust; and as trustee of the Marital Trust under the Schermer Family Trust (collectively, “Defendant”). That order is incorporated by reference herein.

On June 26, 2018 Defendant – now represented by different counsel – filed a motion to transfer case BC617750 to the same probate court that is hearing probate case BP163594 or, in the alternative, to stay the civil law case pending resolution of the probate case.
