Plaintiff was waiting for a public bus at the corner of La Brea Avenue and West Century Boulevard. Defendant’s front left tire and rim detached from the car and rolled across the street. These pieces hit Plaintiff, knocking her to the ground. Plaintiff was sent to the hospital and treated for her injuries.

Plaintiff filed a complaint on May 16, 2016. Since then, discovery began. Defendant was deposed December 1, 2016, and supplied repair and maintenance records on October 10, 2017. These records showed that Defendant had the tires repaired at Sears thirty-six days before the incident that allegedly injured Plaintiff. In light of this new evidence, Plaintiff moves the court to amend the complaint to add a cause of action for strict products liability against Sears Roebuck and add Sears Roebuck as an additional defendant. No opposition has been filed.
